This document was written in accordance with the Food Safety Law of People’s Republic of China, the Administrative Measures for registration of food for special medical purpose and other relevant national standards and applies to all FSMP to be registered in China.
Its six articles set requirements on market name/common name, the language to be used and the relation with products bearing the same name. The document also includes a negative list of terms an FSMP product name should NOT contain, i.e. false or exaggerated therapeutic/functional claims, absolute or vulgar claims and any other misleading denominations, like homonyms or words using characters similar to other foods.
It also states that FSMP products names should reflect the actual composition of the product, showing the category name set by the relevant national standards. The draft regulation details the rules on special categories of FSMP like infant supplements, nutritional supplements and special nutrition supplements. CFDA will be in charge of the implementation and interpretation of these rules.
