CFDA Revise Food Safety Law Implementation Rules (Draft)

The number of articles in the updated Food Safety Law Implementation Rules reduces from 208 to 98. Imported health food, foods for special medical purpose, and infant formula can only be imported if affixed with a registration certificate

On August 14, 2017, China CFDA issued a notification related to the revision of China Food Safety Law Implementation Rules (Draft).

This updated regulation is based on the Food Safety Law of the People's Republic of China. It contains ten chapters and 98 articles, including general principles; risk monitoring and assessment of food safety; food safety standards, production and marketing of food, food inspection; food import and export; handling of food safety incidents; supervision and management; legal responsibility and supplementary provisions. The revision is open to public feedback until October 13, 2017.

Compared with the 2015 version which had 200 articles and the 2016 version which had 208 articles, the latest drafted implementation rules have just 98 articles. The reduction in the number of articles represents a refinement in scope and a removal of repeated content or content detailed comprehensively in other regulations. Furthermore, based on industry feedback and suggestions from both domestic and foreign enterprises, some extremely strict requirements have been removed,

Apart from an overall reduction in the number of articles, another change is that imported health food, foods for special medical purpose, and infant formula should be attached with registration certificate issued by food and drug administration department under the State Council. Moreover, a  registration fee is charged for the registration of health food, FSMP, and infant formula milk powder.

Food Safety Law Implementation Rules (Draft) has been revised in 2015 and 2016 . This latest update is expected to be the last draft before the final version is promulgated in 2017.
