On the 24th of September 2013 the CFDA Department of Food Safety Supervision (Division 3) released a draft regulation for public comment outlining new regulations regarding contract manufacturing of health foods. The new regulation will specify the regulatory responsibilities for foreign enterprise and Chinese enterprise outsourcing manufacturing of their products. The core of the new regulation outlines that both foreign and local health food manufacturers holding valid health food certificates can authorize a proxy to manufacture their licensed product. The authorized proxy will be then bear the bulk of regulatory responsibilities under the Food Safety Law, Health Food Regulations and all relevant reference regulations in addition to the new provisions laid down in this draft regulation.
