MFDS Promulgates Imported Food Inspection Orders

MFDS further detailed new mechanisms to increase the stringency of supervision over high risk imported food products (foods in which there is potential to find non-compliant ingredients). Under new regulations, the government can order business entities to submit to heightened supervisory and inspection requirements (known as an inspection order). The criteria for inspection order cancellation are also detailed.

On Sept 26th, MFDS released Notice No. 2019-84 [1] promulgating the new regulation “Imported Food Inspection Orders”. According to Article 22 of Imported Food Law [2], the inspection authority is entitled to order business entities to submit to inspections of all imported food. This new regulation details the supervision of foods that pose a risk of containing non-compliant ingredients. The procedure and main content are detailed in the diagram below:
