During an August 1st conference in Hangzhou regarding the new Food Safety Law, Jiao Yang, an official from the Standards and Technical Regulations Research Centre of the AQSIQ, delivered a presentation outlining some of the issues facing industry with the pending implementation of the overarching food safety law in October.
Labeling Management
It is addressed in Article 94 of the new Food Safety Law that “overseas exporters and producers shall be responsible for content of the food labels and instructions”. Mr. Jiao pointed out that this is due to the fact that non-compliant labeling of imported food accounts for more than 80% of inspection failures. This specific article has been added to stress the responsibilities of overseas importers and producers, rather than Chinese governmental authorities, in ensuring the compliance of food labels and instructions. He noted that AQSIQ is drafting relevant provisions on labeling management.
Agricultural Food
According to Mr. Jiao, a revision of the “Law on Quality and Safety of Agricultural Products” will be initiated after the new Food Safety Law becomes effective on 1 Oct 2015.
Registration of overseas infant formulation
According to Mr. Jiao “AQSIQ is currently drafting relevant provisions regarding the registration of overseas infant formulation, and so is the CFDA as far as I am concerned”.
