MFDS (Ministry of Food and Drug Safety) promulgated the latest amended revision of Enforcement Rule of Act on Labeling and Advertising of Foods [1] on September 9, 2020. The main amendments are specified as:
1. High Caffeine Content Warning
For the liquid beverage products containing 0.15 milligrams or more caffeine per milliliter, the manufacture or importer shall label warnings of:
"Contains high caffeine" and "total caffeine content ___ milligrams" on the main display side (the side where a trademark or logo is printed);
"Children, pregnant women, and people sensitive to caffeine, please pay attention to caffeine intake.”
The actual caffeine content shifting in a range of 90%~ 110% of the claimed total caffeine content can be accepted. Additionally, for coffee, tea, and other liquid drinks with coffee or tea materials, the real caffeine content shall be no more than 120% of that presented on the main display side.
2. Nutrient Daily Intake Standard of Foods for Children under Two Years old
In spite of the nutrient daily intake standard in the attached Table 5 [2] of the enforcement rule, the intake standard of foods for children under two years shall refer to the RNI stated in National Nutrition Management Act [3].
Grace Period
The revised enforcement rule came into force as of its issuance date. However, in liquid form, health functional food can be exempted from the labels of "high caffeine content warning" until December 31, 2021. In addition, the nutrient daily intake standard of foods for children under two years old can be labeled following the previous requirements prior to December 31, 2021.
