On February 2, 2024, Vietnam’s Ministry of Agriculture and Rural Development (MARD) promulgated Circular No. 01/2024/TT-BNNPTNT1, stipulating HS codes for goods under MARD’s management as well as imported and exported goods subject to specialized inspection in the field of agriculture and rural development. The Circular will be effective on March 30, 2024, replacing the current regulation, Circular No. 11/2021/TT-BNNPTNT.

The Circular is comprised of three appendices. Appendix I provides the HS code table for goods under MARD’s state management. This appendix includes 27 HS code tables, encompassing various fields such as food products, feed, substances like pesticides, fertilizers, agricultural machinery, and more. Below are the key HS code tables pertaining to imported food products.

Table 2: HS code table for the list of other animals in livestock production
Table 5: HS code table for the list of aquatic animals and animal products subject to quarantine
Table 6: HS code table for the list of aquatic species permitted for business in Vietnam
Table 9: HS code table for the list of goods subject to plant quarantine in Vietnam
Table 10: HS code table for the list of imported foods of plant origin
Table 13: HS code table for salt (including table salt and denatured salt)
Appendix II outlines the HS codes for the list of imported goods subject to specialized inspection before customs clearance under MARD’s state management. The specific inspection types include quarantine inspection, quality control inspection, and food safety inspection. Legal basis for conducting specialized inspection is also given in the Appendix. For example, involved legal basis for the inspection of terrestrial animal and animal products include: a) Veterinary Law; b) Decree No. 15/2018/ND-CP; c) Circular No. 25/2016/TT-BNNPTNT; d) Circular No. 35/2018/TT-BNNPTNT; e) Circular No. 09/2022/TT-BNNPTNT; f) Circular No. 24/2013/TT-BYT; g) Circular No. 01/2016/TT-BNNPTNT; h) TCVN 8711-1,2: 2011; i) TCVN 8400; TCVN 8710; j) QCVN No. 8-2:2011/BYT; k) QCVN 8-3: 2012/BYT; and l) Decision No.: 46/2007/QD-BYT.
Appendix III establishes the HS code table for the list of imported goods subject to specialized inspection after customs clearance under MARD’s state management. Legal basis for specialized inspection is also expounded.
