7 Dec 2015 saw another important regulation issued by AQSIQ following the release of the draft of “Detailed Rules for Supervision and Administration on Food Imported by Bonded Mode of Cross-Border E-commerce” in Oct (see CL food news on 16 Oct 2015).
The regulation is named “Rules for Filing of Cross-Border E-commerce Business Operators and Commodities”, which requires both CBEC related business operators including product traders, logistics and storage companies, platform providers, etc. and commodities to be filed with local CIQs. It will come into force as of 1 Jan 2016.
Under the rule, CBEC business operators should provide the following information for filling:
Basic company information
Main product categories
CBEC website name and link
Letter of commitment for quality and faithful operation signed (the operator should establish product quality and safety evaluation system, product recall and traceability system, etc. and provide product testing report or self-declaration of conformity.)
For filing of CBEC products, the following information is needed:
Filing number of the product trader;
Basic product information (HS code, product name and country of origin);
Other info (brand, specification, supplier);
Qualification
Supporting document for the accreditation, registration or filing of the product or manufacturers if required;
Free sale certificate and testing report issued by the third party;
Chinese product instruction;
Consumer warning; etc.
Product compliance statement with Chinese food laws, regulations and national standards
From the materials required to be filed, it is clear that all CBEC products should fully comply with Chinese food regulations. Generally speaking, the regulation over CBEC products will be the same with traditional imported products. The regulation is laying foundation for implementing the afore-mentioned Detailed Rules.
