China GAC Expedites the Customs Release of Prepackaged Food for Exhibition and Dairy Products

China will further increase the pilot reform of the inspection supervision mechanism on imported pasteurized milk. In this case, the customs release for pasteurized milk will be expedited and their shelf life can be expanded. The imported prepackaged food samples used for exhibition are exempted from sampling inspection during the customs release.

On August 20, 2021, ten departments, including GACC, SAMR, NHC, jointly unveiled the “Notification of Deepening the Cross-Border Trade Facilitation Reform and Optimizing Ports’ Business Environment”. In this notification, customs release of food products is involved in two items involve.

Item 2.1.7 Promote the reform of inspection and quarantine supervision mechanism.

On the premise of safety, the pilot reform of the inspection supervision mechanism for imported pasteurized milk should be further increased. That is, the customs will implement supervision measures combining “inspection for release” and “risk monitoring” towards eligible products. The competent authorities will actively promote the acceptation of the inspection results from third-party institutions and release relevant management rules.

Under the traditional supervision mode, imported pasteurized milk are subject to onsite inspection. The cargo cannot be sold on market until the laboratory testing result proves they are qualified. With the implementation of the new supervision mechanism, the cargo can even be given customs release and sold on market on the same day it arrives at the port, as long as its exporting enterprises meet corresponding conditions (such as market access approval, sound risk monitoring results, etc.). In this case, the shelf life of pasteurized milk can be expanded, which further benefits the sales.

Item 2.1.8 Optimize the supervision of imported food and cosmetic samples.

If the imported prepackaged food sample is used for exhibition, then it can be exempted from sampling inspection, premising it conforms to market access requirements.

This measure offers great convenience to enterprises who need to import prepackaged food samples for exhibition. However, they should bear the responsibility of sample compliance.
