China Passes Food Safety Law Implementation Rules

On the State Council executive meeting held on Mar. 26, 2019, Premier Li Keqiang announced the approval of “Food Safety Law Implementation Rules (Draft)”. 3 important articles within the rules will have significant impact on market access requirements and compliance obligations for industry:

1. Food manufacturers and operators’ responsibility, and government supervisory obligations and accountability measures are detailed.

2. Enterprise involved in illegal activities will be subject to more severe punishment in future.

3. The food safety standard and risk monitoring mechanisms are further optimized to ensure food safety and protect people’s health.

The revision to “Food Safety Law Implementation Rules” has undergone 3 major public consultations since its first release in 2009

• 2015: China CFDA opens Food Safety Law Draft Implementation Rules for public feedback

• 2016: State Council Released Revised Draft Implementation Rules of Food Safety Law for Public Consultation

• 2017: CFDA Revise Food Safety Law Implementation Rules (Draft-WTO notification)
