After careful deliberation by the Standing Committee of National People’s Congress (NPCSC), the full text of China’s Food Safety Law (Revised Draft) has been published on the official website for public consultation until 31 Jul 2014.
The revised draft has been expanded from 104 articles to 159 articles with the purpose of building the most stringent legal system for food safety ever. In line with this emphasis on prevention of safety issues, six conditions for risk assessment are specified in article No.19. Requirements of self-inspection for manufacturers and distributers are also added in article No.74.
To keep the entire production and distribution process under strict supervision, new rules have been made offering greater oversight throughout the supply chain. For instance, obligations regarding infant formula (filing of the formula and factory inspection batch by batch) have been included. Meanwhile, contracting manufacture, OEM and sub-packaging of infant formula are explicitly prohibited in article No.69.
The revised draft has also taken into consideration the boom in imported food, for which more detailed requirements for custom clearance have been made in article No.87 and article No.88.
Besides, the draft also establishes a legal reference in which civil liabilities and compensation (article No.138) are highlighted and penalties increased.
