China Revises GMO Regulations

Chinese latest regulatory reform regarding agricultural GMOs stipulates that the competent authority shall entrust a qualified institution to conduct testing prior to issuing a safety certificate.

On October 7, 2017, China State Council released a decree announcing the modification of part of Regulations on Administration of Agricultural Genetically Modified Organisms.

Previous regulations allowed an agency to apply for an agricultural GMO safety certificate by providing a testing report and other necessary materials. The latest version removes the testing report requirement and instead stipulates that the competent authority shall entrust a qualified testing institution to conduct testing.

If an agriculture GMO is imported as a processing materials from an overseas enterprises, besides submitting an application to the authority, the updated version clarifies that testing materials, testing method and etc. are required as well.

In regards to the transit of agriculture GMOs, content involving “National Entry-Exit Inspection and Quarantine Bureau” was deleted in the latest regulation, and article 35 in original version is simplified as “agriculture GMO transiting through China shall comply with requirements in relevant law and regulations”.
