China SAMR Consults on New Production Licensing Rules for Foods for Special Medical Purposes (FSMP)

China’s SAMR has released a draft of the Production License Inspection Rules for FSMP to tighten supervision, updating product categories and strengthening corporate responsibility with new roles like Food Safety Director.
The draft introduces stricter requirements for environmental controls, equipment monitoring, allergen management, and raw material supplier audits, reflecting an alignment with updated national standards.
On November 3, 2025, China's State Administration for Market Regulation (SAMR) released the draft Production License Inspection Rules for Food for Special Medical Purposes (2025 Draft for Comments). The feedback period is open until December 3, 2025.
The revision aims to tighten the production licensing requirements for Foods for Special Medical Purposes (FSMP), align with new national standards, and enhance corporate food safety responsibilities. This draft, if adopted, will replace the current version implemented in 2019. The main revisions cover the following key areas:
