EU amends Regulation (EC) No 1333/2008 on Food Additives as regards the food additives tartaric acid (L(+)-) (E 334), sodium tartrates (E 335), potassium tartrates (E 336), sodium potassium tartrate (E 337) and calcium tartrate (E 354).
The revisions for these five substances were primarily driven by a re-evaluation conducted by the European Food Safety Authority (EFSA). In 2020, an acceptable daily intake (ADI) of 240 mg/kg bw per day, expressed as tartaric acid, was established for tartaric acid-tartrates (E 334–337 and E 354). As a result, these five substances were removed from Point (1) "Group I" of Part C of Regulation (EC) No 1333/2008 and placed into a new group. The conditions of use for these substances have been revised accordingly. Additionally, in 2021, the Commission requested technical data for these substances. For food categories where no data were provided, the authorization of these substances in such categories has been withdrawn.
Part of the revisions:
The use of "Tartaric acid - tartrates" (E 334-337 and E 354) is newly permitted in Category 01.3 "Unflavoured fermented milk products, heat-treated after fermentation" with a maximum level of 750 mg/l or mg/kg as appropriate.
In Category 04.2.5.1 "Extra jam and extra jelly as defined by Directive 2001/113/EC," the entries for the food additives E 334 Tartaric acid (L(+)-) and E 335 Sodium tartrates have been deleted.
Part 4 of Annex III now includes an entry stating that "Tartaric acid - tartrates (E 334-337 and E 354)" can be used in all flavorings with a maximum level of 20,000 mg/kg singly or in combination in the flavoring, and 400 mg/kg in the final product expressed as the free acid.
Foods containing tartaric acid (L(+)-) (E 334), sodium tartrates (E 335), potassium tartrates (E 336), sodium potassium tartrate (E 337), or calcium tartrate (E 354) that were lawfully placed on the market before December 16, 2024, may remain on the market until their date of minimum durability or "use-by date." Further details can be found in Commission Regulation (EU) 2024/1451.
