Korea Unveils Draft Amendment to Special Law of Imported Food Safety Management

If any enterprise hinders or attempts to avoid mandatory onsite inspection all importation activities will be immediately stopped.

On May 18, 2018, Koran MFDS released the draft amendment to "Special Law of Imported Food Safety Management", concerning factory onsite inspection.

The competent authority will block importation if the enterprise hinders or attempts to avoid onsite inspection, including deliberately damaging the manufacturing/processing facility and/or purposely delaying or otherwise obstructing onsite inspection. Currently, only enterprises that reject onsite inspection are subject to this measure.

The current regulation stipulates that only overseas manufacturers that have already filed their information with Korean authorities can apply for onsite inspection. The draft amendment states that it can also be carried out prior to manufacturer filing.
