Thailand Unveils the Exposure Drafts of Five Regulations, Involving Food Labeling, Nutrition Claims and Health Claims

The proposed revisions to labeling regulations involves allergen labeling, warning statements, health claims, reference daily intakes, etc.

In early October 2022, Thailand Food and Drug Administration released the exposure drafts of five MOPH Notifications, including:

  • MOPH Notification Re: Labeling of Prepackaged Food

  • MOPH Notification Re: Nutrition Labeling

  • MOPH Notification Re: Food Health Claims

  • MOPH Notification Re: Food Containing Pesticide Residues

  • MOPH Notification Re: Natural Mineral Water

Any comments can be sent back prior to November 30, 2022.

Labeling of Prepackaged Food

This draft newly includes shellfish, squid and their products into the allergen substances list, and stipulates where the allergen information should be placed. Additionally, it specifies the requirements of warning information and clarifies the situations that are exempted from mandatory labeling items.

Nutrition Labeling

This draft specifies the terms and definition of nutrition labeling, food categories subject to nutrition information labelling, nutrition labeling requirements. Besides, it details the format of and requirements for nutrition information in the appendixes. It is noteworthy that this regulation does not apply to infant formula food and infant formula for special medical purposes.

According to the draft, the reference daily intakes of some nutrients are updated as well, including Vitamin D, Vitamin E, Vitamin K, etc.

Food Health Claim

This draft specifies the types of health claims as well as the preconditions and requirements to label those claims. The appendix lists the allowed expression of health claims for nutrients.

Food Containing Pesticide Residues

The draft amends the maximum residue limits (MRLs) of carbaryl in mangosteen, MRLs of thiametoxam, imidacloprid, dinotefuran in pineapple, as well as MRLs of fluopyram, trifloxystrobin in mango and longan. 

Natural Mineral Water

This draft clarifies that prepackaged natural mineral water should belong to quality-standardized food. It further stipulates the types of natural mineral water, quality of water (before packaging), quality of the final products and its labeling requirements.
