AQSIQ to Strengthen the Certification Standards of Imported Organic Products

AQSIQ promulgated Administrative Measures for Organic Product Certification on the 20th of November 2013, and will execute unified catalog, standard, enforcement regulation, and certification from 1st April of next year. It is applicable to domestic organic product certification as well as production, processing, importing and sales of organic products.

It is stipulated that the content of organic ingredients (referring to the weight or liquid volume, excluding water and salt) shall be equal to or above 95%, and it can only be marked as “organic” on the product package and label after complying with the new standards for organic products.

Countries exporting organic products to China need to establish equivalency with Chinese standards which adhere to China’s organic product certification system managed by the Certification and Accreditation Administration of China (hereinafter referred to as “CNCA”).The CNCA organizes relevant experts to evaluate submitted foreign applications in terms of document review and on-site inspection. Manufacturers, traders, importers or agents that need to obtain the organic product certification of China (hereinafter referred to as “certification consignor”) can also entrust certification authorities approved by CNCA.

Certification consignors shall submit relevant application materials and documents to the certification authority according to the enforcement regulation of organic product certification, including application form, schedule of survey, technological process, product formula, and inputs used in production and processing, the Chinese version of which shall also be submitted.

The copy of organic product authentication certificate, copy of organic product transaction certificate, certification mark, product label, etc. shall be submitted for declaring inspection and quarantine of imported organic products.

Furthermore, if the certificate is forged, altered, unlawfully used, transferred or illegally traded, the violation must be immediately rectified and a fine of RMB 30,000 will also be imposed by local government.
