China Infant Formula: Infant Formula Manufacturers Required to Conduct Self-Inspection of Product Labels

On Dec. 9, 2016, China CFDA released the “Notice for Infant Formula Labeling Standardization and Inspection”, which took effect from the day of announcement.

  • Infant formula manufacturers are required to conduct self-inspection of product labels within three months of this announcement and submit relevant self-inspection results to local FDAs within 15 days after the self-inspection is finished.

On Dec. 9, 2016, China CFDA released the “Notice for Infant Formula Labeling Standardization and Inspection”, which took effect from the day of announcement.

Infant formula should be labeled in accordance with “Administrative Measures for Registration of Infant and Young Children Milk Powder Formula Recipes” as well as relevant national standards including GB 10765-2010 National Food Safety Standard Infant Formula, GB 10767-2010 National Food Safety Standard Older Infants and Young Children Formula, GB 13432 National Food Safety Standard Labeling of Prepackaged Foods for Special Dietary Uses, etc.

Infant formula manufacturers are required to conduct self-inspection of infant formula labels within 3 months from the date of announcement. Verification of compliance with the following is required:

  • Product name: it is prohibited to use different font sizes or colors for the product name to mislead consumers.
  • Sources of raw materials and auxiliary materials: expressions of “imported milk source”, “from overseas pastures”, “organic pastures” or any equivalent terminology should not be used.
  • Content claims: negative content claims relating to substances not contained in the product formula are prohibited
  • Function claims: indication relating to functional properties such as “intelligence development”, “immunity enhancement”, “intestinal protection”, etc are prohibited. No expression relating to “humanized milk” or other equivalent terminology should be indicated.

Infant formula manufacturers and traders should report the self-inspection results to local FDAs within 15 days after the self-inspection is finished. Overseas infant formula manufacturers should comply with the same requirements and submit relevant information through their sale agencies.
