[Updated] South Korea Modifies the Regulation on Inspection of Imported Food

Fast customs clearance procedure of imported raw materials for manufacturing food products is introduced. The import inspection procedures for large quantities of agricultural products imported by bulk ships is to be simplified. The residual pesticide inspection items are expended. China’s lichee and broccoli, Brazil's raw coffee beans, the Philippines' Mango, and the U.S.'s roasted coffee, etc. are to be excluded from the scope of "foods confirmed as safe".

South Korea implements the Regulation on Inspection of Imported Food on June 19, 2023. 


The Ministry of Food and Drug Safety (MFDS) proposed amendments to the Regulation on Inspection of Imported Food on March 2, 2023, for public opinions1. Stakeholders can send suggestions to MFDS before May 1, 2023. 

The first proposed amendment involves the fast customs clearance procedure of imported raw materials for manufacturing food products. It specifies that the materials that require refining or processing before use and food flavorings can enjoy fast customs clearance after the importers obtain the confirmation from MFDS. This proposed change aims to expedite the customs clearance process. Please note that only registered food manufacturers, food additive manufacturers, and distributors in South Korea can apply for fast customs clearance of raw materials. 

Additionally, the proposed draft seeks to simplify the import inspection procedures for large quantities of agricultural products imported by bulk ships. For instance, if wheat, corn, and beans are imported to South Korea through a single ship shared by several importers, the ship would usually need to visit several ports, which requires several import inspections at each port. This can be time-consuming and costly. However, under the exposure draft, these importers can submit the import declaration to the relevant regional MFDS at the same time when the ship arrives at the first port. This change can help reduce the transport delays and enhance the efficiency of the import process. 

MFDS also proposed to expand the residual pesticide inspection items for imported agricultural products from 69 to 113, to ensure the safety and quality of imported agricultural products.

Moreover, as per the proposed amendments, China’s lichee and broccoli, Brazil's raw coffee beans, the Philippines' Mango, Myanmar’s cowpea, Italia’s roasted coffee, and the U.S.'s roasted coffee are excluded from the scope of foods confirmed as safe, for they have non-compliances records in the recent inspections, and thus are excepted from the document inspection (the easiest import inspection type) objects.
