Texas Adopts Mandatory Warning Labels for Foods Containing Specific Ingredients

Food products containing any of 44 targeted additives must bear prominent warning labels. The requirements apply to food product labels developed or copyrighted on or after January 1, 2027.

In February 2026, the Texas Department of State Health Services (DSHS) adopted new rules (25 Texas Administrative Code, Chapter 229, Subchapter II, §§229.1001 - §§ 229.1005) mandating warning labels on food products containing specific ingredients deemed not recommended for human consumption by authorities in Australia, Canada, the EU, or the UK. The rules mandate that products containing any of 44 targeted additives, including common artificial colors, preservatives, and oils, must bear a prominent consumer warning.
