On Jan. 27, 2022, World Trade Organization (WTO) announced a notification regarding the proposed revision to Thailand’s plastic food packaging regulations, which was proclaimed by Thai Food and Drug Administration (FDA). Comments should be sent back within 30 days from the circulation of the notification.
The key amendments of the draft are summarized as follows:
The definition of “containers made from recycled plastics” is detailed. Now it includes the interpretation of recycling processes to manufacture recycled plastics used as food contact.
The technical indicators of certain food contact plastic are revised, such as the overall migration limit, the restriction for primary aromatic amines (PAAs), and the limit for metal migration etc.
Annex 1 lists 12 specific plastic containers and plastic containers for milk and milk products. However, if the plastic is not listed in Annex 1, safety evaluation is required. Enterprises should submit the safety assessment report to Thai FDA for approval before selling.
The draft stipulates that the plastic containers for milk and dairy products should be made from polyethylene (PE), ethylene 1-alkene copolymerized resin, polypropylene (PP), polystyrene (PS) or polyethylene terephthalate (PETP).
If the plastic containers have been used to package fertilizers or similar substances, then it is prohibited for food-contact use.
It is noteworthy that food contact plastic that were in use prior to the implementation of this notification can continue to be used for no more than three years from the effective date.
