On January 27, 2026, the Government of Vietnam issued Resolution No. 66.13/2026/NQ-CP, establishing new regulations regarding the declaration and registration of food products, including food packaging materials. The resolution mandates that organizations and individuals responsible for placing products on the market must strictly adhere to specific procedures for declaring applicable standards or registering product declarations, depending on the product category.
The Resolution applies to a wide range of products, including processed pre-packaged foods, food additives, processing aids, and instruments and packaging materials intended to contain food.
Specifically, the "Declaration of Applicable Standards" (Chapter II) is required for packaging tools and materials that come into direct contact with food if these items do not yet have specific technical regulations regarding quality or safety indicators, or if there is no designated organization to certify conformity with national technical regulations (QCVN).
For packaging materials falling under the scope of Chapter II, companies must submit a dossier in Vietnamese containing:
A Declaration of Applicable Standards form (Model No. 01)
Testing Results: A product testing result sheet (original or certified copy) issued by a testing laboratory accredited under ISO/IEC 17025 within 12 months prior to the submission date
Power of Attorney to act as the declarant for the Declaration of Applied Standards from the manufacturing facility or the product owner (in case of authorization)
According to Resolution No. 09/2026/NQ-CP released on February 4, 2026, the effective date of Resolution No. 66.13/2026/NQ-CP shall be suspended until April 15, 2026.
Therefore, the Resolution No. 66.13/2026/NQ-CP shall take effect from April 16, 2026, until a replacement document for the Law on Food Safety dated June 17, 2010 is issued, but no later than February 28, 2027.
For products that were self-declared before the effective date of this Resolution, organizations have 12 months from the effective date of ths Resolution, to complete the declaration of applicable standards under the new regulations. Products manufactured or imported during these transitional periods may continue to circulate until their expiry dates.
