On May 13, 2025, the governor of Washington State signed into law - SB 5628, concerning a phased restriction of aluminum or brass cookware or utensils containing lead. The amendment takes effect on July 27, 2025.
In Washington State, the prohibition on the sale of cookware containing lead has already been legislated under the Revised Code of Washington (RCW) 70A.565.020 on June 6, 2024. This regulation prohibits all metal cookware and its components, regardless of the used metallic material, that contain lead at a level of more than 5 parts per million. The deadline for compliance is January 1, 2026.
In comparison, this amendment implements a phased restriction on aluminum or brass cookware (including its components) and utensils. Cookware that is completely enclosed by stainless steel or electronic cooking devices with removable cooking containers are not within the scope of restriction.
The details for the phased restriction are as follows:
No manufacturer or retailer may manufacture, sell, offer for sale, distribute for sale, or distribute for use in this state aluminum or brass cookware (including its components), or aluminum or brass utensils at a level of more than:
90 parts per million, beginning January 1, 2026;
10 parts per million, beginning January 1, 2028.
After December 2030, the Washington State Department of Ecology may lower the established 10 parts per million limits on the grounds of human health concern. This decision will also be made based on the feasibility for manufacturers of cookware and its components to achieve.
