89 Batches of Food Rejected by China Customs in July 2019

GAC seized 89 batches of substandard foods imported from 28 countries/regions in July. Labels and packaging, hygiene and credentials problems were major issues.

On Sep 4, General Administration of Customs (GAC) released the list of non-compliant food products rejected by GAC during port inspection in July.[1] 89 batches of foods imported from 28 countries/regions had issues (download the list).[2] Major categories of food rejected include cereal-based snacks, fruits, vegetables & their products, and beverages.

In the non-compliance list, there are four batches of Ukrainian, Australian and Spanish milk powder, including a batch of Analac brand infant formula. The infant formula was rejected due to expiration date issues, the remaining batches failed to submit the correct credentials.

6 batches of German Forge whey protein powder failed to comply with labeling standards. Relevant stakeholders should be aware that all prepackaged foods shall conform to GB 7718 National Food Safety Standard for the Labeling of Prepackaged Food[3] and GB 28050 National Food Safety Standard for the Nutritional Labeling of Prepackaged Food[4]. Besides, if there are mandatory national product standards for the specific food, then imported foods should also comply with these (if imported through general trade channels).
 
In this case, according to the product package and related advertisements the whey protein powder product is designed for sports groups including athletes and those who work out regularly to keep fit. However, the product was rejected as technically it was misclassified as a solid drink due to its similarity in form with instant solid drink. Although there is a specific product standard for sports nutrition, namely GB 24154-2015 General Standard for Sports Nutrition Food[5], many companies chose to comply with the less stringent GB 7101-2015 National Standard for Drink[6], which is a common practice among stakeholders. Enterprise can avoid the more difficult regulatory compliance requirements by simply avoiding use of terminology/advertising indicating the product is a “sports nutrition food (运动营养食品)” on the labels.
