Chile Proposes New Regulation for Food Contact Materials and Articles

The proposed regulation sets safety, traceability, and labeling requirements for food contact materials like plastics and metals, including specific migration limits on chemicals.

On August 13, 2025, Chile's Ministry of Health (MINSAL) notified WTO a draft regulation regarding materials and articles intended to come into contact with food.

It establishes the general requirements for food contact materials and articles, including compliance with good manufacturing practices and safety regulations, a traceability system and labeling requirements.

The proposed regulation covers different materials, including metals, plastic materials, active and intelligent materials. 

Metals (including utensils, containers, packagings made of metal) in contact with food and their raw materials must not contain more than 1 percent of impurities consisting of lead, antimony, zinc, copper, chromium, iron, or tin taken together, nor more than 0.01 percent of arsenic, nor other contaminants consisting of metals or metalloids that may be considered harmful. 

The active substances must be expressly authorized for use. The intelligent materials shall ensure the food safety in accordance with the regulation. 

For plastic materials intended to come into contact with food, MINSAL will pubish the List of Authorized Substances which may be used in the manufacture of plastic layers of food contact plastic materials and articles, by means of a Technical Standard. It should be noted that unintentionally added substances and polymerization aids are permitted despite not being listed. 

The Technical Standard will also include restrictions of specific migration limits for plastic materials and articles. In addition, the plastic materials and articles should also comply with the global overall migration limits (OML) of 60mg/kg, or 10 mg/dm2
