EU Proposes Maximum Levels for Mineral Oil Aromatic Hydrocarbons in Food

1. The EU has proposed specific maximum levels for mineral oil aromatic hydrocarbons (MOAH) in a wide range of foods, including milk, dairy products, infant formula, food for infants and young children, food supplements, and food additives, to address genotoxic and carcinogenic risks. 2. The draft regulation, amending Regulation (EU) 2023/915, is open for comments until May 10, 2026 and is scheduled to apply from January 1, 2027, with phased reductions for certain categories such as food supplements through 2030. 3. Food business operators must strengthen MOAH monitoring and mitigation across the entire supply chain, including processing and food contact materials, to comply with the new limits and transition provisions.

On March 11, 2026, the European Union released a draft regulation through the WTO to amend Regulation (EU) 2023/915, setting maximum levels for mineral oil aromatic hydrocarbons (MOAH) in various foodstuffs. This measure aims to ensure a high level of human health protection by mitigating potential genotoxic and carcinogenic risks associated with MOAH exposure. The final date for comments on this draft is May 10, 2026, and the regulation is proposed to enter into force on January 1, 2027.
