EU to Amend Regulation (EU) 2023/915 on Maximum Levels for Certain Contaminants in Foods

EU is to revise Regulation (EU) 2023/915, regarding the maximum levels of the following contaminants in certain foods: T-2 and HT-2 toxins, deoxynivalenol, and the sum of 3-monochloropropanediol (3-MCPD) and 3-MCPD fatty acid esters.

As per three WTO notifications issued on January 4, 2024, EU is to amend Regulation (EU) 2023/915 on Maximum Levels for Certain Contaminants in Food. Feedbacks shall be submitted prior to March 4, 2024.

Key Content

EU is to add the indicator of “T-2 and HT-2 toxins” under Section 1 (Mycotoxins) of Annex I to Regulation (EU) 2023/915. Requirements for this indicator are raised for a) baby food and processed cereal-based food for infants and young children, b) food for special medical purposes intended for infants and young children, and c) many cereals and cereal products.

Food items listed in the Annex that were lawfully placed on the market prior to July 1, 2024, are permitted to remain on the market until their date of minimum durability or use-by date.

The maximum levels of deoxynivalenol in baby food, infant formula, foods for special medical purpose (FSMP) intended for infants and young children, and various cereal products are revised. The revisions regarding baby food and infant FSMP are as below.

  • G/SPS/N/EU/709 regarding the sum of 3-monochloropropanediol (3-MCPD) and 3-MCPD fatty acid esters

The maximum levels of the sum of 3-monochloropropanediol (3-MCPD) and 3-MCPD fatty acid esters in infant formula and infant FSMP are revised as below.
