Food Safety and Quality Division of Malaysia opens two drafts for public opinions on May 10, 2023. The two drafts mainly propose amendments to both the main body and schedules of the Food Regulations 1985.
Revisions to the Main Body
1. Revisions to “Regulation 84 Skimmed Milk, Skim Milk, Non-fat Milk or Separated Milk”
As per Food Regulations 1985, products under Regulation 84 shall be labeled with the warning “not suitable for infants except on medical advice”. The draft newly limits infants within the scope “under two years old”. The font size is also stipulated, i.e., no less than 10 points and in bold.
2. Revisions to “Regulation 85 Pasteurized Milk”
The processing technique is revised with the deletion of repetitive words.
3. Revisions to “Regulation 91A Malted Milk Powder”
The amendment deletes the sentence “(Malted milk powder) may contain not more than 0.8 per cent of soya bean lecithin” and “(Malted milk powder may contain) permitted food conditioner”.
4. Revisions to “Regulation 92 Recombined Milk”
The definition is revised.
Before | Recombined milk shall be the product prepared from the constituents of milk combined with water or milk or both… |
After | Recombined milk shall be the product prepared by combining milk fat and non-fat milk solids with or without addition of water to achieve the appropriate composition of milk products… |
5. Revisions to “Regulation 93 Reconstituted Milk”
The definition is changed as below.
Before | Reconstituted milk shall be the liquid product prepared by the addition of water to full cream milk powder… |
After | Reconstituted milk shall be the liquid product prepared by the addition of water to dried or concentrated milk in the required amount to achieve the appropriate ratio of water to solids… |
Moreover, the draft indicates that reconstituted milk can no longer contain food conditioners.
Revisions to the Schedules
1. Revisions related to DHA or/and ARA
The draft adds the condition for the use of DHA’s nutrition claim in Fifth A Schedule, i.e., the amount shall be not less than 40mg/100g in solid form.
When claiming the function “DHA and ARA help in the development of infant’s vision”, the minimum amount of ARA is revised from 34mg to 25mg per 100kcal.
2. Revisions related to amino acid, fatty acid and nucleotide
The draft specifies the requirements for the claims related to amino acid, fatty acid and nucleotide. For example, when the product bears the claim high in amino acid, then the amount shall reach the minimum level for the claim “high in” as stipulated in Fifth A Schedule.
