MERCOSUR to Overhaul Packaged Food Labeling

1. MERCOSUR’s draft GMC Resolution No. 03/25 Rev. 1, notified by Argentina to the WTO on January 7, 2026, proposes a comprehensive overhaul of labeling rules for packaged foods, with highly prescriptive requirements on fonts, colors, layout, and minimum font sizes. 2. The draft significantly tightens ingredient declaration rules—lowering the composite ingredient disclosure threshold from 25% to 5% and specifying clearer declarations for additives—while also strengthening prohibitions on misleading claims. 3. Staggered transition periods (12–60 months) are set for different product categories, but businesses serving the MERCOSUR market will still face major label redesigns, formulation reviews, and increased compliance costs.

On January 7, 2026, the Argentina notified the World Trade Organization (WTO) of a draft technical regulation raised by the Southern Common Market (MERCOSUR), which proposed a comprehensive update to the labeling requirements for packaged foods. The draft, GMC Resolution No. 03/25 Rev. 1, aims to enhance consumer information by introducing stricter rules on legibility and presentation, replacing the current regulations GMC No. 26/03— the MERCOSUR Technical Regulation for Labeling of Packaged Foods and GMC No. 06/94 regarding the Declaration of Ingredients on the Label of Prepackaged Foods. The deadline for submitting feedback on the draft is March 8, 2026.
