Updated| South Korea Requires Product Photo for Import Declaration. Under What Situations Can It be Exempted?

South Korea requires enterprises to submit product photos for import declaration and grants exemptions for specified foods.

On December 7, 2022, the Korean Health Supplements Association (KHSA) released a list of submission dossiers for import declaration, including the document scope for each situation for every allowable exporting country. On November 25, 2022, the Ministry of Food and Drug Safety (MFDS) promulgated the Enforcement Rule of Imported Food Act1 (Rule)

The new Rule enhances the safety control on imported fishery products. Previously, the fishery products, which have undergone a thorough inspection, don't need to retake a thorough inspection when being re-imported to South Korea in five years if its exporting country, product name, and exporting business entity are one and the same. The Rule newly adds a prerequisite that the product’s foreign establishments shall also be the one and same. This provision will enter into force on December 26, 2023. 

Another notable amendment in the Rule is that product's photo became a mandatory document for the import declaration. And soon after, on December 6, 2022, MFDS released an Announcement2 to specify the imported foods which can be exempted from submitting product photos. 

The exemption situations are compiled in the below table:

Imported foods under 1) ~3) of Paragraph 2 (A) in Attached Table 9 of the Rule, including:

a. Imported foods for earning foreign exchange as specified in the Enforcement Decree of the Foreign Trade Act3

b. Imported foods used as raw materials for manufacturing food products

c. Imported food for research and investigation purposes

Any of the following foods:

a. Fishery products, agricultural products, forest products, and edible meat which are not alive, refrigerated or packaged, and are in natural forms

b. Foods imported by tank lorry, such as crude alcohol, edible oil and fat, etc.

c. Non-refined/processed food raw materials for sale

d. Food additives (flavorings and flavoring preparations)
