On the press conference held on June 8, 2022, Thailand Ministry of Public Health (MOPH) announced the legalization of planting hemp and using cannabis in food, which means that starting from June 9, 2022, planting, selling, importing, and consuming hemp and hemp products are legal in Thailand1. However, extract substances whose THC (tetrahydrocannabinol) content over 0.2% are still listed as Narcotics and cannot be used in food.
The legalization of cannabis does not mean that the government will no longer supervise the use of cannabis. On June 11, Thailand MOPH stated that prepackaged food containing cannabis is regarded as specially controlled food, and it must be granted approval before selling or importing2. Cannabis product shall meet corresponding quality standard, and the THC content should not exceed the permitted level. Regarding the label of food containing cannabis, it should clearly indicate the ingredients, warning information and consumption suggestion. In addition, the competent authority will continue to supervise the advertising of cannabis food.
When it comes to hemp seeds, on June 12, 2022, Ministry of Agriculture and Cooperatives announced that the government would support the import of hemp seeds, which will facilitate hemp being a new cash crop3. Pest-free certificate and non-GMO certificate issued by the country of origin must be attached for the importation of hemp seeds.
