2018 China Food Legislation Agenda Unveiled

The revised “Implementation Rules of Food Safety Law” are still under discussion, and amendment to administrative measures regarding special food fling/registration is expected to be finalized by mid-2018.

According to an announcement made by the former CFDA issued in Feb. 2018, 13 regulations and rules are listed into the 2018 food legislation development plan, including amendment to “Implementation Rules of Food Safety Law”, “Administrative Measures for Product Formula Registration of Infants and Young Children Formula Milk Powder” and “Administrative Measures for Food for Special Medical Purposes”

The revised “Implementation Rules of Food Safety Law” has been under discussion by the State Council. Revision to “Administrative Measures on Health Food Registration and Filing” has been submitted and the Special Food Registration Department plans to submit the amendment of “Administrative Measures for Product Formula Registration of Infants and Young Children Formula Milk Powder” and “Administrative Measures for Food for Special Medical Purposes” in June, 2018. Wang Hong, former CFDA special food director, revealed that for FSMP registration privacy terms, such as R&D data, would be refined. 2018 food legislation work was transferred to State Administration for Market Regulation after the institutional reform plan released in March of this year. The replacement of CFDA, AQSIQ and SAIC with the SAMR may facilitate the release of Implementation Rules of Food Safety Law (click here for detailed analysis).
