GACC Clarifies Implementation Matters of Decree 248 & 249, Involving Food Import Declaration and Labeling

Assorting with the upcoming implementation of “Regulations of the People’s Republic of China on the Registration and Administration of Overseas Manufacturers* of Imported Food (Decree 248)” and “Measures of the People's Republic of China for the Administration of Import and Export Food Safety (Decree 249)” on Jan. 1, 2022, General Administration of Customs of China (GACC) released a follow-up notice to clarify implementation matters of these two decrees.

Comment regarding to the new food raw material can be sent to xspyl@cfsa.net.cn before Jan. 08, 2022.

China’s New Labeling Requirements for Imported Food in 2022

On April 13 2021, General Administration of Customs of China (GACC) issued the latest version of "Administrative Measures on Safety of Import and Export Food" (hereafter as the "Measures"), which will take effect on January 1, 2022. Later on November 5, 2021, GACC released a follow-up document as the interpretation for the Measures. Among many critical changes brought by the Measures, new labeling requirements are of top priority for stakeholders to keep an eye on. CBEC Platform Tmall Global Releases Interpretations for False Advertising of Health Supplements

On Nov. 22, 2021, Tmall Global, China's major cross-border e-commerce (CBEC) platform, released "Interpretations for False Advertising in the Healthcare Sector", which mainly targets the imported health supplement, in order to further crack down the violations and regulate chaos in the imported health supplement industry. Once the product information is regard as false advertising, the product information will be removed from the platform. In serious cases, Tmall Global may remove the product page and return the product. ChemLinked extracted five typical false advertising that stakeholders should avoid.
