[Updated] Philippines Releases Guidelines on the Issuance of Import Permit as “Samples Only” for Processed Food Intended for R&D Purposes

On May 7, 2024, the Philippines FDA issued FDA Circular No.2024-004 Guidelines on the Issuance of FDA Import Permit as "Samples Only" for Prepackaged Processed Food Products Intended for Research and Development, which will take effect 15 days after the publication in the Official Gazette. On March 30, 2023, the Philippines FDA released a draft document titled "Rules and Guidelines on the Issuance of Import Permit as ‘Samples Only’ for FDA Regulated Products Intended for Research and Development Purposes".

Philippines to Streamline the Import Procedures of Agricultural Products

On April 18, 2024, the President of the Philippines signed Administrative Order No. 20 regarding Further Streamlining Administrative Procedures and Policies, and Removing Non-Tariff Barriers on the Importation of Agricultural Products with immediate effect. Within 30 days, corresponding competent authorities shall formulate supporting guidelines necessary for the effective implementation of this Order.

On February 29, 2024, the Philippines Food and Drug Administration (PFDA) published a draft of supplemental Guidelines aimed at enhancing the management and conduct of product recalls for prepackaged processed food products. In accordance with the provisions of the Food Safety Act of 2013, the Guidelines is designed to ensure the safety and compliance of food products in the market. In January of 2024, the Philippines Senate introduced and revealed Senate Bill No. 2518 titled An Act Prohibiting Producers and Manufacturers of Baby Food From Adding Sugar on Their Products, and for Other Purposes, also known as No Added-Sugar on Baby Foods Act. Currently, this new bill has been undergone the first reading and is now pending in the committee.

Philippines Proposes Guidelines for the Classification of Vitamins and Minerals for Food/Dietary Supplements

On January 9, 2024, the Philippines FDA unveiled a draft document titled Guidelines for the Classification of Vitamins and Minerals for Food/Dietary Supplements under Processed Food Product Repealing the Provisions for Food in the Office Order No. 22 s. 1991 entitled "Guidelines for the Classification of Vitamins and Minerals as Drug or as Food". All concerned stakeholders may submit comments via email to gapascual@fda.gov.ph before January 26. The new draft aims to provide guidelines to all Food Business Operators (FBOs) on the classification of vitamins and minerals as food/dietary supplements, and set updated limit of vitamins and minerals to be classified as food/dietary supplements.
