Five Food Categories Including Dairy and Infant Food Are Subject to Mandatory Foreign Manufacturer Registration in India

India makes it mandatory for foreign food manufacturing facilities to register with FSSAI when exporting milk, meat, egg powder, infant food and nutraceuticals.

On October 10, 2022, the Food Safety and Standards Authority of India (FSSAI) issued an order on foreign food manufacturer registration, making it mandatory for foreign food manufacturing facilities to register with FSSAI when exporting the following food categories to India.

(1) Milk and milk products;

(2) Meat and meat products, including poultry, fish and their products;

(3) Egg powder;

(4) Infant Food;

(5) Nutraceuticals.

The competent authorities of the exporting countries should provide the list of current manufacturers of these food products as well as those planning to export such products.

The order is issued in accordance with the provisions in the Food Safety and Standards (Import) First Amendment Regulations, 2021, which became effective on June 1, 2022. It stipulates that foreign food manufacturing facilities falling under specific categories shall register with the authority before exporting to India. The list of food categories that required registration will be updated from time to time depending on their potential risks.

Additionally, the revisions involve the registration and inspection requirements for foreign food manufacturing facilities.

Registration requirements:

Foreign food manufacturing facilities can apply for registration directly or through an authorized representative. The required documents by FSSAI for registration application and renewal are as follows:

(1) License or registration or similar document issued by the concerned country's authority;

(2) Consent of owner of the foreign food manufacturing facility for inspection by FSSAI officials;

(3) Detail composition of products;

(4) Authorization for the authorized representative (if applied through an authorized representative).

(5) Any other documents or information that may be required by food authority.

The registration is valid for two years, whose renewal shall be made at least thirty days before the expiry date. The registration shall be suspended or cancelled if foreign food manufacturing facilities or their food products exporting to India are not in compliance of the FSS Act and rules.

Inspection requirements:

Foreign food manufacturing facilities shall be inspected if required by the authority according to FFSAI standards. In addition, certain food categories are covered by the existing mandatory Bureau of Indian Standards Certification Mark Scheme. It has been compulsory for foreign manufacturers of these products to accept the Scheme of Testing & Inspection (SIT) and obtain BIS certification. Also, the scheme of inspection includes the requirements listed in Schedule 4 of the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011. In this case, no inspection shall be necessary for these food categories.
