Korea to Revise Regulations on Functional Foods

On Dec. 16, 2014, Korea MFDS released the announcement to revise the enforcement order and detailed rules for the implementation of functional food regulations. The period for public consultation will end on January 26th 2015. The final version is expected to be formally implemented in the first half of 2015.

Draft Functional Food Regulation: Most Significant Potential Changes

  1. It is a requirement that all functional foods sold in vending machines provide relevant product information.

  2. Functional foods and conventional foods should be displayed separately.

  3. Currently manufacturers and importers of functional foods should complete registration for products with annual sales volume above KRW 5 billion. This number will be changed to KRW 1 billion after the revision of the regulation. Under this amended rule the number of enterprises requiring registration of products will increased from 29 to 134.

  4. Manufacturers of functional foods that require OEM production due to the limitation of part of the production process are allowed to conduct OEM production for the whole production process. If the OEM production is conducted more than once a quarter, the consignor should inspect relevant OEM conditions and label the name of the manufacturing facilities on minimum sales package of products. The manufacturers can use the same storage facility to reduce unnecessary costs.
