Thailand Prohibits the Use of CBD in Baby Food

Although Thailand legalized the use of cannabis in food, such ingredient cannot be added into infants and young children’s formula food, supplementary baby food and caffeine-containing beverage.

In the first half of 2021, Thailand approved the use of non-addictive parts of cannabis and hemp plants (including hemp seed, oil and protein) in food products under certain conditions and issued corresponding product quality requirements. In July 2021, Thailand’s Ministry of Public Health (MOPH) unveiled notification No. 4271 and No. 4282, detailing the usage of cannabis components in food.

As revealed by No. 427 notification, it is prohibited to produce, import or sell the following five products that contain cannabis components:

(1) Food for infant and food of uniform formula for infant and small children

(2) Modified milk for infants and modified milk of uniform formula for infant and children

(3) Supplementary food for infants and young children

(4) Caffeine-containing beverages

(5) Other food prescribed by the Ministry

To ensure food safety, the competent authority stipulated in No. 428 notification that the residual of THC (tetrahydrocannabinol) and CBD (Cannabidiol) shall not be detected in the food mentioned above.

Besides, No. 427 notification specified the product standard for food containing cannabis or hemp components, involving the contaminant level, labeling, food additives, package, etc. All these items should be compliant with corresponding regulations. However, it is noteworthy that food products containing cannabis or hemp components are subject to additional labeling requirements. For example, it should indicate series of warning such as “Not apply to Children, pregnant women and lactating women”, "Those allergic or sensitive to THC or CBD should be careful when having the product", “The maximum dose is two packaged units per day”, etc.
