[Updated] Keeping Pace with Legislative Progress: Discussions on Utensils, Containers, and Packaging in Japan

The subcommittee under MHLW irregularly holds online meetings to discuss various revisions related to utensils, containers, and packaging. The proposed revisions will be evaluated and responded to by the Food Safety Commission before undergoing necessary administrative procedures such as standard revisions and public solicitation of opinions.

Japan Releases Requirements for Food Utensils and Packaging Manufacturers

On March 28, 2024, Japan’s MHLW newly issued the Notification Requirements for Enterprises Involved in the Manufacturing of Utensils and Packaging. According to Article 57 of the Food Sanitation Act, enterprises are obligated to notify their products before the products are launched. This announcement provides a comprehensive clarification on which types of food packaging enterprises are subject to notification with the government.

Japan Bans a Designated Food Additive in Food Products

On March 15, 2024, Japan Ministry of Health, Labor and Welfare (MHLW) issued an amendment to revise the food additive list. As per the amendment, 3,6-dimethyl-5,6,7,7a-tetrahydro-2(4H )-benzofuranone will be removed from the Essence List of 18 Kinds as of December 31, 2024.

Japan Introduces Updated Standards for Food Additives

Japan Ministry of Health, Labor and Welfare (MHLW) recently issued Notice No. 29, announcing updates to certain provisions in the Japan's Specifications and Standards for Food Additives. The notice declares updates including various aspects such as testing and experimental requirements for food additives, ingredient specifications for additive ingredients, storage requirement, as well as requirements for manufacturing and usage. To facilitate enterprises’ better adaption to the new rules, MHLW has granted them a one-year transition period.

Japan Bans on Six Substances in Food Products

On December 27, 2023, the Ministry of Health, Labour and Welfare (MHLW) of Japan announced six substances as "designated drugs" under the category of "dangerous drugs" with effect from January 6, 2024. The designated drugs include HHCV, HHCB, HHC, HHCH, HHCP, and “HHC-Octyl, HHCjd”.

Japan to Implement New Policy on Food Contact Materials

On November 30, 2023, the Ministry of Health, Labour and Welfare (MHLW) of Japan issued Notification No. 324, officially announcing the Positive List (PL) for food utensils, containers, and packaging from June 1, 2025. Additionally, partial modifications have been made, including elimination, consolidation of substance names, and changes in restrictions, as a result of updating the PL management scope for synthetic resins. These modifications will also come into force on June 1, 2025.
