Canada Proposes to Modernize the Regulations for Foods for Special Dietary Use and Infant Foods

On November 28, 2023, Health Canada announced to seek public comments on a proposal to modernize the regulations for foods for special dietary use (FSDU) and infant foods, which are currently regulated by the Divisions 24 and 25 of the Food and Drug Regulations. Any comments can be sent to bns-bsn@hc-sc.gc.ca until February 6, 2024.

Japan to Implement New Policy on Food Contact Materials

On November 30, 2023, the Ministry of Health, Labour and Welfare (MHLW) of Japan issued Notification No. 324, officially announcing the Positive List (PL) for food utensils, containers, and packaging from June 1, 2025. Additionally, partial modifications have been made, including elimination, consolidation of substance names, and changes in restrictions, as a result of updating the PL management scope for synthetic resins. These modifications will also come into force on June 1, 2025.

In November of 2023, China consulted on amended GB 29938 General Rules for Food Flavorings for public feedback. South Korea updated Food Code. Japan unveiled two drafts of tablets and capsules food products. Indonesia notified WTO six drafts on halal certification regulations. India released rectifiable labeling information for imported food. EU adopted revamped rules to reduce, reuse and recycle packaging. UK proposed MRLs for pencycuron in food. US proposed to further eliminate the use of brominated vegetable oils in food. Canada to update permitted nutrient content statements and claims. Australia and New Zealand changed the conditions for making the voluntary “No Added Sugar” claims.

China Revises Administrative Measures for FSMP Registration

On December 3, 2023, State Administration for Market Regulation (SAMR) unveiled the updated Administrative Measures for Registration of Foods for Special Medical Purpose, replacing the 2016 version. Major revisions include priority review and approval procedures, situations not approved for registration, labels, penalties, and measures to optimize the registration procedure. The new version will come into force on January 1, 2024.
