The year 2021 witnessed many significant regulatory updates in the Asia-Pacific region. In China, several significant food standards were released, such as the new GB standard for infant formula milk powder. It is noteworthy that GACC released two important regulations regarding imported food as well. South Korea has many critical regulatory revisions in 2021, regarding labeling requirements, food raw material inventory and the HACCP accreditation for overseas Kimchi factories. Japan also adopted new food additives and labeling requirements in the past year.

China Consults on Health Function Catalogue for Health Food (2022) and Other Supporting Documents
Jan 17, 2022
As per Food Safety Law, China implemented the catalogue management system for health food functions, and released the corresponding Administrative Measures to regulate the formulation process, inclusion criteria and adjustment of health food functions in 2019. Later in 2020, China State Administration for Market Regulation (SAMR) released Health Function Catalogue Allowed for Health Food Claims Non-nutrient Supplement (2020 Draft) (hereafter as the “Catalogue”) and a series of supporting documents for public comments. On Jan. 13, 2022, SAMR opened the new drafts of the Catalogue and four supporting documents for public feedback. Any comments can be sent to baojiangongneng@cfe-samr.org.cn prior to Feb. 12, 2022.

ASEAN Harmonised Standards and Requirements for Health Supplements

Since 2004, ASEAN, with the support from the ASEAN Consultative Committee for Standards and Quality Traditional Medicines and Health Supplements Product Working Group (ACCSQ TMHS PWG) has been working on the harmonisation of Health Supplement standards and requirement. The harmonisation has finally comes closer to completion following the recent ACCSQ TMHS PWG meeting held in November 2020, where it has been agreed for the finalisation of ASEAN Agreement on Health Supplements. The finalised ASEAN Agreement on Health Supplement will be submitted to the Senior Economic Official Meeting (SEOM) for signing by the ministers by end of 2021. Implementation of the Agreement will be thereafter.

China to Expand Raw Material Directories and Function Claims of Health Food

On December 20, 2021, China State Administration for Market Regulation ("SAMR") opened the drafts of "Health Food Raw Materials Directory - Nutrient Supplement (2022)" and "Health Function Catalogue Allowed for Health Food Claims - Nutrient Supplement (2022)", as well as "Health Food Raw Material Directory - Protein" for public comments. China’s New Labeling Requirements for Imported Food in 2022

On April 13 2021, General Administration of Customs of China (GACC) issued the latest version of "Administrative Measures on Safety of Import and Export Food" (hereafter as the "Measures"), which will take effect on January 1, 2022. Later on November 5, 2021, GACC released a follow-up document as the interpretation for the Measures. Among many critical changes brought by the Measures, new labeling requirements are of top priority for stakeholders to keep an eye on. CBEC Platform Tmall Global Releases Interpretations for False Advertising of Health Supplements

On Nov. 22, 2021, Tmall Global, China's major cross-border e-commerce (CBEC) platform, released "Interpretations for False Advertising in the Healthcare Sector", which mainly targets the imported health supplement, in order to further crack down the violations and regulate chaos in the imported health supplement industry. Once the product information is regard as false advertising, the product information will be removed from the platform. In serious cases, Tmall Global may remove the product page and return the product. ChemLinked extracted five typical false advertising that stakeholders should avoid.
