China Rejects Infant Formula Violating New Regulations

A batch of infant formula originally from USA which failed to pass Shenzhen CIQ’s site inspection, has been returned just several weeks after China’s newly implemented regulations for infant formula were launched.

The US-made products, totaling 34,000USD, were deemed substandard with reference to the rules of General Standard for the Labeling of Prepackaged Foods (GB 7718-2011). The labeling of the ingredient “soybean phosphatides” on the products was the cause of the products label inspection failure. Dr. Jacky Yu, a senior regulatory expert from REACH24H, would like to remind all exporters that ingredients for baby formula are required to be labelled with reference to Chinese national standards. Under this case, the proper labeling should have been “phospholipids”.

As is specified in AQSIQ Announcement 133 of 2013 on Enhancing the Imported Baby Formula Management, imported baby milk powder must bear Chinese labels in compliance with national standards, which should be printed on the actual minimum sales packaging from 1 April 2014 before they enter China. Any infant formula products unable to meet Chinese labeling requirements under the stringent regulatory environment will be either returned or destroyed.
