China

On July 29, 2024, China National Health Commission (NHC) issued the finalized version of the national food safety standard legislation plan for 2024. The plan includes 35 food standards. Compared to the draft version, two standards for food additives—gellan gum and nickel—have been newly added. Additionally, one standard from the draft plan, concerning the determination of theanine in tea leaves in food, has been removed in the final version. The legislative bodies will now proceed with the legislation work for the listed food standards. (Read More)

South Korea

On July 10, 2024, the Ministry of Food and Drug Safety (MFDS) disclosed the latest version of Food Code. MFDS established the standards and specifications for “nutritional supplements for patients with respiratory diseases”, and revised the criteria for the use of Garcinia Cambogia extract in food. Besides, the residue tolerance standards for four pesticides are modified. (Read More)

More regulation highlights in South Korea:

Japan

On July 12, 2024, Japan’s Consumer Affairs Agency (CAA) released the Draft of Manufacturing or Processing Standards for Food with Function Claims Containing Natural Extracts in the Form of Tablets, Capsules, etc. (hereinafter the “Standards”), and planned to implement it starting September 1, 2024. However, stakeholders can still submit comments through the e-GOV website until August 16, 2024. (Read More)

More regulation highlights in Japan:

Southeast Asia

On July 19, 2024, Thailand Food and Drug Administration (FDA) unveiled Ministry of Public Health Notification (No. 450) on the Labeling of Prepackaged Food (hereinafter MOPH Notification No. 450), which replaced MOPH Notification No. 367 on the Labeling of Prepackaged Food and its three amendment notifications (MOPH No. 383, No. 401 and No. 420). The new labeling regulation became effective starting from July 19, 2024, with a two-year grace period for food stakeholders to make preparation.

More regulation highlights in Southeast Asia:

India

On July 3, 2024, in order to facilitate business, the Food Safety and Standards Authority of India (FSSAI) introduced the instant issuance of licenses and registrations for certain food business categories, including importers. The instant issuance is initially rolled out in the states and union territories of Assam, Delhi, Gujarat, Jammu & Kashmir, and Kerala starting from June 28, 2024. This rollout excludes partnership and registered firms. The validity of the instant license and registration is one year. (Read More)

European Union (EU)

In July 2024, the EU issued two regulations to amend Commission Regulation (EU) 2023/915 on Maximum Levels for Certain Contaminants in Food. The two regulations 1) defer the application date of lower maximum levels for ergot sclerotia and ergot alkaloids in food; and 2) introduce the maximum level of nickel in certain foods. (Read More)

United States (US)

On July 3, 2024, the U.S. Food and Drug Administration (FDA) finalized the Revocation of Authorization for Use of Brominated Vegetable Oil in Food, which is effective on August 2, 2024. The authority announced to revoke the authorization for using brominated vegetable oil (BVO) in food due to safety concerns. The compliance date for this rule is one year after the effective date, to provide the opportunity for companies to reformulate, relabel, and deplete the inventory of BVO-containing products. Canada

On July 11, 2024, Health Canada unveiled M-FAA-24-07 with immediate effect, modifying the List of Permitted Sweeteners to extend the use of sucralose. This modification allows the use of sucralose in liquid protein preparations represented for use under medical supervision and by individuals 18 years of age or older, with the maximum usage as 0.08%. Australia and New Zealand

On June 14, 2024, Therapeutic Goods Administration (TGA) of Australia published a notice to announce the issuance of Therapeutic Goods (Permissible Ingredients) Determination (No. 2) 2024, replacing the previous instrument. Major changes involve the addition of 5 new ingredients and the revision of requirements for 4 ingredients. The new determination took effect on June 14, 2024. (Read More)
