Global Food Regulation Highlights | October 2023

In October of 2023, China consulted on 24 GB food standards. South Korea introduced new food additives. Japan released key updates to positive list for food utensils, containers, and packaging. Vietnam proposed to revise the mandatory EPR requirements. India banned four highly hazardous pesticides. EU updates regulations for three novel foods. UK updated consumer advice on CBD food products. US updated compliance program for infant formula. Canada permitted the use of a new food enzyme. Australia and New Zealand amended the Australia New Zealand Food Standards Code.

China 

On October 18, 2023, China National Health Commission (NHC) announced to seek public comments on 11 national food safety standards, involving dairy products, food contact materials (FCM), food for special medical purposes (FSMP), canned food, and food additives. Any comments can be submitted online prior to December 15, 2023. (Read More)

South Korea

On September 27, 2023, the Ministry of Food and Drug Safety (MFDS) published a draft of the Standards and Specifications for Food Additives (Food Additive Code) for public opinion. The key contents of the revision include (1) specifying new definition of and sulfites’ residue standards for non-alcoholic beverages derived from fruit wines, (2) establishing the exemption provisions for applying food additive usage standards to imported raw materials, and (3) permitting seven new food additives, including vitamin K2, a nutritional ingredient in health functional foods. Japan

On October 4, 2023, the Ministry of Health, Labour and Welfare (MHLW) of Japan held a meeting of the Food Sanitation Subcommittee, Pharmaceutical Affairs and Food Sanitation Council. During the meeting, the revised positive list for substances allowed in food contact utensils, containers, and packaging was officially announced. Additionally, on October 12, a supplementary list of monomer combinations for base resins was added. (Read More)

More regulation highlights in Japan:

Southeast Asia 

On October 20, 2023, Vietnam announced to consult on the revision on Decree No. 08/2022/ND-CP Detailing a Number of Articles of the Law on Environmental Protection, including provisions related to extended producer responsibility (EPR). Major changes include the revisions on situations that can be exempted from the recycling and waste treatment responsibility, the permitted ways to conduct self-organization recycling, the receiver of the declaration form, etc. Notably, "Appendix XXII List of Products and Packaging Subject to Mandatory Recycling, and Mandatory Recycling Rates and Recycling Specifications" is also with some changes. More regulation highlights in Southeast Asia:

India 

On October 6, 2023, India published the Insecticides (Prohibition) Order, 2023 to ban four highly hazardous pesticides, which are Dicofol, Dinocap, Methomyl and Monocrotophos. However, Monocrotophos is given a one-year transitional period. The Order comes into effect immediately on the date of publication. (Read more)

EU 

In October of 2023, the EU issued authorization and amendment regarding three novel foods, involving 3-Fucosyllactose produced by a derivative strain of Escherichia coli K-12 DH1, partially defatted chia seed (Salvia hispanica) powders and 6′-Sialyllactose sodium salt produced by derivative strain of Escherichia coli W (ATCC 9637).

UK

On October 12, 2023, the Food Standards Agency (FSA) recommended that healthy adults should not consume more than 10mg of Cannabidiol (CBD) per day, roughly equivalent to 4-5 drops of 5% CBD oil. (Read More)

US 

On October 6, 2023, the U.S. Food and Drug Administration (FDA) released its updated compliance program for infant formula, which incorporates valuable insights gained from several years of experience. This program provides detailed elaboration of inspections, sampling, laboratory analysis and regulatory strategy. Canada 

On October 11, 2023, Health Canada unveiled NOM/ADM-0209 with immediate effect, modifying the List of Permitted Food Enzymes to enable the use of Cellulase from Trichoderma reesei RF11412 in Brewers' mash and Distillers' mash, with the requested maximum level as "Good Manufacturing Practice". Australia and New Zealand 

On October 30, 2023, Food Standards Australia New Zealand (FSANZ) issued Amendment No. 222 to amend the Australia New Zealand Food Standards Code. The revision involves 2 schedules, Schedule 18 Processing aids and Schedule 26 Food produced using gene technology. (Read More)
