China

On September 20, 2024, General Administration of Customs of China (GACC) published the list of non-compliant food products in August 2024. A total of 301 batches of imported food from 35 countries/regions were rejected. Most non-compliant imported food in August came from Ecuador (16.6%, all aquatic products), followed by Australia (15.6%, mostly beef) and Japan (12.3%, mostly snacks). (Read More)

Regulation highlights in other areas of China:

South Korea

The Ministry of Food and Drug Safety (MFDS) published the draft of the Enforcement Rule of Imported Food Act for public feedback on September 6, 2024. Suggestions are welcome before October 16, 2024. The modifications proposed in the draft are as follows:

(1) Exemption from the obligation to submit test and inspection reports required for food materials imported to South Korea for the first time, when the usage purpose of imported raw materials is changed from manufacturing to selling.

(2) Reduction of administrative penalties for good import entities.

(3) Strengthening safety management by shortening the period for registering the traceability of imported health functional foods and establishing standards for charging penalties on falsely reporting imports. (Read More)

Japan

On September 18, 2024, Japan's Ministry of Health, Labour and Welfare (MHLW) released an amendment to the Maximum Residue Limits (MRLs) for 12 pesticides and veterinary drugs. The amendment came into effect immediately upon publication. However, the changes to the MRLs for six specific pesticides and veterinary drugs will be implemented one year after the publication date. Southeast Asia

In May 2024, Vietnam's Ministry of Health issued Circular No. 08/2024/TT-BYT, abolishing the Article 13 of Circular No. 24/2019/TT-BYT on the Management and Use of Food Additives. On September 6, 2024, the authority issued "Circular 09/VBHN-BYT Regulations on Management and Use of Food Additives", which is now the latest effective consolidated document to check the food additive management rules in Vietnam. India

On September 11, 2024, the Food Safety and Standards Authority of India (FSSAI) has decided to extended the the instant licenses and registrations for certain food business categories nationwide, excluding the States/UT of Chandigarh, Himachal Pradesh, and Meghalaya. The provision has taken into effect from August 31, 2024. (Read More)

More regulation highlights in India:

European Union (EU)

On September 20, 2024, European Commission announced to add Undecafluorohexanoic acid (PFHxA), its salts and PFHxA-related substances to the Restriction List under REACH (Annex XVII to Regulation (EC) No 1907/2006).  This amendment was published in the Commission Regulation (EU) 2024/2462 on the Official Journal of the European Union. It will come into force on October 10, 2024. The ban will affect food contact materials. Read more here. (Read More)

United States (US)

On September 27, 2024,  the Food and Drug Administration (FDA) published a notice to remind enterprises of the facility registration renewal. The registration and renewal period is open from October 1 to December 31, 2024.  A food facility will be considered expired if the facility’s registration is not renewed by December 31, 2024. Canada

On September 6, 2024, Health Canada modified the List of Permitted Food Enzymes to authorize the use of two food enzymes from new sources. Besides, on September 10, Health Canada modified the List of Permitted Emulsifying, Gelling, Stabilizing or Thickening Agents to extend the use of polyglycerol esters of interesterified castor oil fatty acids. Australia and New Zealand

On September 13, 2024, Food Standards Australia New Zealand (FSANZ) released Amendment No. 231, involving P1028 – Infant Formula, to amend the Code. This approval mainly introduces new product category, composition, and labelling of infant formula products. The changes take effect upon gazettal, with a five-year transition period granted by FSANZ. (Read More)
