China’s Taiwan Food Utensils, Containers and Packaging Regulation

1. Definition

  • Food utensils: instruments, tools, and containers in direct contact with foods and food additives.

  • Food containers and packaging: containers and packaging in direct contact with foods and food additives.

3. Market access approval

3.1 Registration of businesses

Before importing food utensils, food containers and packaging products containing plastic food contact material, importers shall register with the municipal or county's competent authorities before operations commence. After registration, regular updates to registration details are required.

During the registration, product information including "name of the food contact material (FCM) in Chinese or in English, or CAS number", "name of FCM supplier", "FCM model number" are mandatory. Other required information can be found in Regulations Governing the Registration of Food Businesses.

3.2 Import inspection

Imported food utensils, food containers and packaging products must be inspected at the port of entry as per the Regulations of Inspection of Imported Foods and Related Products. Obligatory applicants or representatives shall file an inspection application within fifteen days prior to the entry date. The authority may proceed product inspection with the following measures, taking into account the inspection history of products from the same origin and with the same CCC code, as well as the inspection authority's consideration of health and safety:

  • Batch-by-batch inspection,

  • Randomly-selected batch inspection (regular randomly-selected batch inspection / reinforced randomly-selected batch inspection)

  • Batch-by-batch verification

  • Certification inspection

  • Oversee inspection

An import permission notice will be issued if the products pass the inspection. Imported products fail the inspection may be returned, destroyed or subject to corrective measures as mandated.

4. Product compliance

4.1 Product requirements

Food utensils, food containers and packaging products exported to Taiwan shall be in line with the Sanitation Standard for Food Utensils, Containers and Packages. Products that are toxic, tend to cause unfavorable chemical reactions, or are otherwise harmful to health are prohibited.

4.2 Label

Food utensils, food containers and packaging products with plastics on their food contact surface shall conspicuously indicate the following matters in Chinese and common symbols:

  • Product name

  • Name of materials and thermal resistance temperature (in the case of a mixture of two or more materials, each of the materials shall be indicated separately)

  • Net weight, volume or quantity

  • Name, telephone number and address of the responsible domestic company

  • Country of origin

  • Manufacturing date, and the expiry date or the term of validity if the product has a limited duration of storage

  • Precautions for use or microwavable and other warnings

  • Indication of “for food contact use” or equivalent wording

  • Indication of whether it is reusable or disposable

  • Food utensils, food containers and packaging with polyvinyl chloride (PVC) or poly vinylidene chloride (PVDC) on its food contact surface, shall be labelled with a note that the products shall not directly contact with high-fat and high temperature food

  • Other matters designated by the central competent authority if applicable

Refer to Act Governing Food Safety and Sanitation, The Items of Food Utensils, Food Containers or Packaging Shall Be Labelled as Required, Regulations on the Labeling of Food Utensils, Food Containers, or Packaging, Principles for Labelling the Names of Plastic Materials in Food Utensils, Containers and Packaging for detailed requirements.

In addition, as per the Scope of the Enterprises Responsible for Placing Relevant Recycling Symbols on Goods and Containers, the Size and Placement of the Symbols, and other Requirements, the importers of food utensils, food containers and packaging products shall register with environmental authorities and label products with recycling symbols.
